This website is operated by T&C Global Ecom LLC, doing business as Everlind. Throughout this site, "we," "us," and "our" refer to Everlind. By visiting everlind.com and/or making a purchase, you agree to be bound by these Terms of Service, along with any additional policies referenced here (including our Privacy Policy, Refund Policy, and Shipping Policy). These Terms apply to everyone who uses the site — browsers, customers, and anyone else interacting with it.
Please read these Terms carefully. If you don't agree with them, please don't use the site or purchase from us. Continuing to use the site after we post changes to these Terms means you accept the updated version.
Our store runs on Shopify, which provides the e-commerce platform behind Everlind.
1. Eligibility — By using this site, you confirm that you're at least the age of majority in your place of residence, or that you have permission from a parent or guardian to use the site. You agree not to use Everlind for any unlawful purpose, and not to violate any laws applicable to you while using the site (including intellectual property laws). You also agree not to transmit any viruses, malware, or other harmful code. Violating these Terms may result in immediate loss of access to our services.
2. General Conditions — We may refuse service to anyone, for any reason, at any time. Information you submit (excluding payment details) may be transmitted unencrypted across networks and may be adapted to fit technical requirements of different systems. Payment information is always encrypted in transit. You agree not to copy, resell, or otherwise exploit any part of the Everlind site or service without our written permission. Section headings in these Terms are for convenience only and don't affect their meaning.
3. Accuracy of Site Content — We try to keep information on the site accurate and current, but we can't guarantee that everything is free of errors at all times. Content is provided for general information and shouldn't be your only basis for a decision — use of the site is at your own risk. We may update or change site content at any time without obligation to notify you.
4. Changes to Products, Services, and Pricing — Prices are subject to change without notice. We may modify, suspend, or discontinue any part of the site or our services at any time, and we won't be liable to you or anyone else for doing so.
5. Products — We try to display product colors and details as accurately as possible, but we can't guarantee that your screen will show them exactly as they appear in person. We reserve the right to limit the sale of any product to certain people, regions, or quantities, and to discontinue any product at any time. Offers are void where prohibited by law.
6. Order and Account Accuracy — We may refuse or cancel any order, including orders that appear to be placed by resellers or distributors, or orders that exceed reasonable per-customer limits. If we cancel or change your order, we'll try to reach you using the contact details provided at checkout. You agree to provide accurate, current information when placing an order or creating an account, and to keep your contact and payment details up to date. 7. Third-Party Tools and Links — We may link to or provide access to third-party tools or websites that we don't control. These are provided "as is," without any warranty from us, and any use of them is at your own risk — please review the relevant third party's own terms.
8. Feedback and Submissions — If you send us feedback, ideas, or suggestions, you agree that we can use them freely, without any obligation to credit or compensate you. Please don't submit anything unlawful, abusive, or that infringes someone else's rights — you're responsible for what you send us.

10. Errors and Corrections — Occasionally the site may contain typos or inaccuracies related to pricing, product details, shipping times, or availability. We reserve the right to correct these and to cancel or adjust orders affected by an error, even after you've placed an order, without prior notice.

12. Disclaimer of Warranties and Limitation of Liability — We don't guarantee that the site or our services will be uninterrupted, error-free, or perfectly secure. Everything is provided "as is" and "as available," without warranties of any kind beyond what's expressly stated. To the fullest extent allowed by law, Everlind, T&C Global Ecom LLC, and our team, partners, and suppliers won't be liable for any indirect, incidental, or consequential damages arising from your use of the site or our products, including lost profits or data — even if we've been advised such damages were possible. Where a jurisdiction doesn't allow this kind of limitation, our liability is limited to the greatest extent the law permits.
13. Indemnification — You agree to defend and hold Everlind, T&C Global Ecom LLC, and our team harmless from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or violation of any law or third party's rights.
14. Severability — If any part of these Terms is found unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of the Terms will remain in effect.
15. Termination — You may stop using the site at any time. We may suspend or terminate your access if we believe you've violated these Terms, without prior notice. Obligations that naturally survive termination (such as payment for orders already placed) will continue to apply.
16. Entire Agreement — These Terms, together with our other posted policies, make up the entire agreement between you and Everlind regarding your use of the site, replacing any prior agreements or understandings on the subject.
17. Dispute Resolution — We'd rather resolve any issue directly — please reach out to us first at contact@everlind.com. For customers in the United States, Canada, and Australia: any dispute arising from these Terms or your use of the site will be resolved through individual binding arbitration rather than in court, and neither party may bring a claim as part of a class or representative action. You may opt out of this arbitration agreement by emailing contact@everlind.com within 30 days of your first purchase, including your name, address, and a clear statement that you wish to opt out. Nothing in this section limits any non-waivable consumer protection rights you have under the law of your country of residence — including the right of customers in the European Union and United Kingdom to bring claims before their local courts and consumer protection bodies, regardless of this arbitration clause.
18. Governing Law — These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, except where local consumer protection law in your country of residence requires otherwise.
19. Changes to These Terms — We may update these Terms from time to time by posting a revised version on this page. It's your responsibility to check back periodically — continuing to use the site after changes are posted means you accept them.
